Idaho Code Ann. § 54-5511, Disclosure and Recordkeeping — License Renewal

Requires licensed midwives to obtain informed consent prior to providing care. Specifies the information that they must disclose as part of the informed consent process (e.g., a description of their training and experience, a client specific emergency protocol, the risks and benefits of a home birth, etc.). Requires midwives to retain a copy of the signed consent for at least nine years following their last date of care provided to the client. Requires midwives to notify clients that have a history of the conditions, diagnoses, or disorders identified in § 54-5505(1)(e)(ii)(diabetes, renal disease, sleep apnea, etc.) that they must obtain care from a licensed physician prior to receiving care from the midwife. Requires midwives to notify clients that have a history of the conditions, diagnoses, or disorders identified in § 54-5505(1)(e)(iii) (e.g., prior cesarean section, loss of pregnancy in the second or third trimester, etc.) that they should seek care from a physician during their pregnancy. Specifies the data that midwives must annually report to the Idaho State Board of Midwifery as part of their license renewal application (e.g., number of deliveries performed, number of transfers, number of perinatal deaths, etc.).
