“Denial of or refusal to renew license; suspension and revocation of license and other disciplinary measures under the regulation of professions and occupations law”
Occupational therapists and occupational therapist assistants may be denied a license or face disciplinary sanctions for a variety of grounds including:
- Failing to report to the Department of Health any health care professional who is violating the law;
- Failing to perform any legal obligation placed on an occupational therapist or occupational therapy assistant;
- Making a false report or failing to file a report required by state or federal law;
- Paying or receiving any commission, bonus, kickback, or rebate or engaging in any split-fee arrangement for patient referrals;
- Engaging in sexual activity with a patient;
- Making deceptive representations in the practice of occupational therapy;
- Failing to conform to prevailing standards of care; and
- Being unable to practice occupational therapy with reasonable skill because of illness or substance use.
