“Notification to administrative entities under the Adult Protective Services Act”
The Department of Children and Family Services, the Agency for Persons with Disabilities, or the Department of Elderly Affairs must notify the appropriate state attorney if they receive a report that an employee abused, neglected or exploited a vulnerable adult.
If any time during a protective investigation, the Department of Children and Family Services believes that a Medicaid participating facility abused, neglected, or exploited a vulnerable adult, then the department must notify the Medicaid Fraud Control Unit within the Department of Legal Affairs.
If a health care facility’s employee is a perpetrator of abuse, neglect or exploitation of a vulnerable adult, the Department of Children and Family Services must notify the Agency for Health Care Administration, Division of Health Quality Assurance.
