Medical Peer Review in Florida
Each hospital must establish a peer review board.1
An emergency medical review committee must review the professional medical competence of emergency technicians and paramedics.2
Any member of a peer review organization or committee must report to the Department of Health the name of any dentist who he believes has violated the law.3
A hospital, ambulatory surgical center, or health maintenance organization’s medical review committee must screen the professional and medical competence of health care professionals.4 Each member of a committee, board, group, commission or other entity that is established to improve health care quality is immune from civil liability for any act made in performance of his or her duties.5
The Department of Health must annually submit a report to the Florida legislature information regarding the medical profession including: complaints received and investigated and the disposition of the complaints; and a description of disciplinary actions taken.6 The Department of Health or a medical licensing board may report any criminal activity committed by a health care professional to the appropriate authorities.7 The Department of Health and any medical licensing board may not disclose any information to any person who is not lawfully entitled to the information.8
