“Licensed facilities; peer review; disciplinary powers; agency or partnership with physicians under the public health law”
Each hospital must peer review their physicians as a condition of licensure. Hospitals’ medical peer review committees are exempt from the federal and state antitrust laws. If a peer review panel disciplines a physician for medical malpractice or another reason, the hospital must report the disciplinary action within 30 days to the Agency for Health Care Administration’s Division of Health Quality Assurance. Any person who participates in peer review is not civilly liable for the peer review committee’s actions.
