Health Information Technology in Florida
Florida government agencies may establish a collaborative client information system to share data in a variety of areas including health.1 The Department of Health, the Department of Children and Family Services, and the Agency for Persons with Disabilities may share confidential health information necessary to administer their programs.2
The Agency of Health Care Administration must establish the Florida Center for Health Information and Policy Analysis, which must establish a comprehensive health information system to provide for the collection of health-related data and statistics.3 The Agency for Health Care Administration is responsible for developing electronic and paper forms which may be used by a health care provider to document patient authorization for the use or release of the patient’s health record.4 Health care facilities must electronically submit inpatient discharge data to the Agency for Health Care Administration.5 The Agency for Health Care Administration must establish an information system that distributes and receives information and services as a basis for the agency’s public education programs.6
The Agency for Health Care Administration may operate a certified electronic health record technology loan fund.7
An electronic prescribing clearinghouse is established to prevent prescription drug abuse, improve patient safety, and reduce unnecessary prescriptions.8 The Department of Health must establish a comprehensive electronic database system to collect information on controlled substance prescriptions and provides prescription information to a patient’s health care provider and pharmacist.9
Any person conducts business in Florida who maintains an electronic data system that includes personal information must provide notice of any breach of the security of the system to any Florida resident whose unencrypted personal information was acquired by an unauthorized person.10
