“Florida Electronic Health Records Exchange Act”
A health care provider may release or access a patient’s health record without the patient’s consent in order to treat the patient for an emergency medical condition.
The Agency for Health Care Administration is responsible for developing electronic and paper forms which may be used by a health care provider to document patient authorization for the use or release of the patient’s health record. A health care provider that exchanges a patient health record upon receipt of an authorization form is not liable for violating physician-patient privilege.
