Correction or amendment or statement of disagreement — Procedure
If a health care provider agrees to amend or correct a health care record, the provider must:
- Add the amending information as a part of the health record; and
- Mark the challenged entries as corrected or amended and indicate the place in the record where the corrected or amended information is located.
If a health care provider refuses to make a proposed correction or amendment, the provider must:
- Permit the patient to file a concise statement of the correction or amendment requested and the relevant reasons as a part of the record; and
- Mark the challenged entry to indicate that the patient claims the entry is inaccurate or incomplete and indicate the place in the record where the statement of disagreement is located.
A health care provider who receives an amendment or correction request from a patient must forward any changes made to the patient's information or record (including any statement of disagreement) to any third-party payer or insurer to which the provider has disclosed the challenged information.
