“Implementation of the Act under the public safety and welfare law”
The joint health care reform oversight committee must determine all policies within the state regarding the implementation of the Patient Protection and Affordable Care Act. The insurance commissioner must obtain approval from the committee prior to initiating any rulemaking proceeding related to PPACA. The insurance commissioner must make periodic reports to the committee on the provision of PPACA that have taken legal effect in New Hampshire and on the status of the commissioner’s implementation and enforcement efforts of the law. The commissioner must not implement or enforce any provision of PPACA that has been ruled unconstitutional or invalid by the United States Supreme Court.
