Licensed health professionals (e.g. medical doctors, nurses, midwives) must report to the Department of Health (“department”) upon learning, within in their professional capacity, that a child under the age of five has a “physical defect.” The report must contain the name of address of the child and their parents or guardians, a description of the physical defect, and other information required by the department and must be sent within 48 hours of discovering the defect. The department must submit a copy of the report to the State Board of Education within 10 days and must maintain the report for a minimum of six years.
