“Process and General Standards”
When an individual applies for admission to a nursing facility or when a nursing facility resident applies for Medicaid, the nursing facility or the department of aging’s designee will determine whether the individual requires a consultation. If a nursing facility, hospital or individual determines that an applicant or resident does not require a consultation, the entity will provide the department of aging’s designee with the following information:
- · The expected length of stay in the NF;
- All known information concerning existing formal support systems, existing informal support systems, potential formal support systems, and potential informal support systems that are available to the individual; and
- Whether the individual has previously been admitted to a NF.
If a consultation is warranted, it must provide the applicant or resident with each of the following components:
- Any long-term care options available to the individual that may meet the needs of the individual;
- Information explaining the methods to use to apply for the long-term care options;
- A personalized list of factors to consider when deliberating over long-term care options, including any known potential risks that may be associated with the options and applicable resources that the individual may use to learn about the quality of services; and
- Information explaining the opportunities and methods for maximizing the independence and self-reliance of the individual, including information about support services provided by the family, friends, and community of the individual that may be able to meet the needs of the individual.
A nursing facility that has a provider agreement with the department of job and family services may only admit or retain an individual as a resident once it is clear the nursing facility has complied with these standards and there has been a long term care consultation with the individual. The information provided during that consultation is not binding and once the individual is admitted, they may choose their long term service and support to best meet their needs.
