Persons aged 65 years or older may report charges for health care services they haven’t received to the department of elderly affairs. Upon verification of a billing error, a health care provider must repay the patient the amount over-billed plus an additional 10% of the billing error. Such repayment does not prevent the patient from seeking recovery under any other applicable Rhode Island laws. The 10% penalty does not apply to diagnostic related group (DRG) billings.
