Commissioner Duties and Responsibilties
The Commissioner of Health must establish an adverse event reporting system to improve the quality of health care in the state. The reporting system must consist of the following:
1. Mandatory reporting 27 adverse health events;
2. Mandatory root cause analysis and corrective action plan;
3. Analysis of the information by the Commissioner to determine trends;
4. Sactions against facilities that fail to comply with reporting requirements.
The Commissioner is required to analyze root cause analyses and corrective action plans to determine whether there are systemic problems in the health care system. The Commissioner is also required to put out annual reports detailing adverse health events by facility and providing corrective action plans and recommendations. The Commissioner may also impose sanctions on those facilities that fail to timely report adverse events or fail to comply with the other terms of the law.
