Penalties and Immunity
Any health care facility or individual who willfully violates the disclosure, consent or other laws pertaining to the blood borne pathogen testing, reporting or recording is guilty of a misdemeanor. A health care facility, physician or other individual who has disclosed blood borne pathogen test results to an emergency medical services person is immune from civil liability if the disclosure was done in good faith and attempts were made to comply with the rules regarding blood borne pathogens.
