Idaho Admin. Code r. 16.03.11.202, Appointed Advocate

Requires an ICF/ID administrator to appoint an advocate for an individual if the individual’s parent or legal guardian is unwilling, unable, or unavailable to participate in the individual’s care. Permits an individual or their parent or legal guardian to request the appointment of an advocate. Clarifies that facilities must still advise individuals of their rights even if they have been declared incompetent. Prohibits persons employed by the facility from serving as an individual’s advocate. Lists the priority of advocates as (1) parents; (2) an interested family member; and (3) other interested parties.
