Grants the local ‘Ombudsman for the Elderly program’ representative (‘local ombudsman’) access to long-term care facilities, residents of long-term care facilities, and any medical or social records relevant to a complaint investigation. Requires the local ombudsman to obtain resident consent prior to communicating privately with a resident and prior to visiting their room. Clarifies that HIPAA does not bar a long-term care facility from releasing identifying health information to the Office of the State Ombudsman for the Elderly.
