All institutionalized residents must receive a comprehensive evaluation, diagnosis, prognosis and description of habilitation goals within thirty days of their admission. On this basis, a written habilitation plan must be established. All residents must receive habilitation and care consistent with the habilitation plan, which must be comprehensively re-evaluated by the institution’s professional staff at least every ninety days. At the resident or his counsel’s request, the plan must be provided to the resident’s counsel and to any designated private physician.
