Executive Order No. 42: Establishing the New York Health Benefit Exchange
This Executive Order was issued by Governor Cuomo to establish the New York Health Benefit Exchange on April 12, 2012. The Exchange was established within the NY Department of Health to facilitate enrollment in health care coverage and the purchase and sale of qualified health plans. The Exchange must also allow individuals to receive premium tax credits and cost sharing reductions and employers to receive small business tax credits, if eligible. The Exchange must also enter into agreements with other federal, state and local agencies, as necessary to carry out the functions of the Exchange. The Exchange must also establish regional advisory committees, consisting of various interested parties to provide recommendations on the Exchange. The Exchange must be financially self-sustaining by Jan. 1, 2015.
