Rhode Island establishes a civil cause of action against persons that knowingly and willfully (1) charge patients or persons acting on behalf of a patient more than the Medicaid rate for services paid under the Rhode Island Medicaid Program; or (2) charge, solicit, accept, or receive a payment, gift, or donation as a condition of admitting a Medicaid patient into a health care facility. Persons injured by such actions may recover damages equal to three times the amount of the charge.
