Federally-Facilitated Health Exchange; Authority of the Commissioner
The law requires that if a federally-facilitated exchange is established in New Hampshire, that the Insurance Commissioner retain its authority, including licensing of producers/carriers, rate approval, reinsurance, network adequacy, grievance standards, and unfair trade practices, for products sold on the exchange. Any entity that sells insurance through the federally facilitated exchange must be a licensed producer. The Commissioner is also authorized to issue standards for navigators working with the exchange. The Commissioner must authorize individuals, employers or employees to enroll in the exchange through the website.
