Medicaid/CHIP Data Requirements in Maine

The state of Maine requires sharing of information on Medicaid beneficiaries across various state agencies.1  Maine law also allows the Commissioner of the Department of Human Services to request that financial institutions match their records with public assistance rolls at the expense of the Department.2

There are also specific regulations that govern when and to whom the Department of Human Services is permitted to disclose confidential Medicaid information.  The law allows the Department of Human Services to disclose confidential Medicaid information from hospitals or nursing homes to federal or state agencies, professional licensing boards, recipients of Medicaid benefits or their representatives, and to an individual or agency investigating or treating a beneficiary who has been abused or neglected.  However, The Department is required to disclose confidential Medicaid information from hospitals or nursing homes to law enforcement investigating instances of abuse, neglect, or the commission of a crime, and to appropriate state and federal authorities in the administration of the Medicaid program.3
