Records; disclosure - Me. Rev. Stat. tit. 22, § 1828

The Department of Human Services may release confidential Medicaid information from hospitals or nursing homes to the following:

• Employees of state or federal agencies charged with carrying out their official functions;
• Professional licensing boards;
• An agency or person investigating an instance of patient neglect or abuse;
• A physician treating a patient who may have been abused or neglected;
• A resident or recipient of benefits;
• A parent, guardian or spouse of a resident or recipient of benefits.

The Department is required to disclose confidential Medicaid information from hospitals or nursing homes to the following:

• Law enforcement investigating instances of abuse or neglect, or the commission of a crime;
• Appropriate state and federal authorities in the administration of the Medicaid program.

Any information that is disclosed to any organization must not be further disseminated.
