Resident's rights regarding medical condition, care, and treatment
Nursing homes must make sure that residents and their guardians: (1) receive information regarding their health and medical conditions unless providing the information would harm the patient; (2) have the ability to participate in their care and treatment; (3) are allowed to refuse treatment; and (4) provide informed consent, in writing, prior to participating in experimental research.
Any decision to deny the resident or their guardian access to information about the resident’s health must be documented in the resident’s medical record.
