Refusal of admission to inpatient treatment — Effect of directive
An individual that (1) executes a mental health advanced directive that is not revocable during a period of incapacity; (2) consents, or has their authorize agent consent on their behalf, to voluntary admission for inpatient mental health treatment; and (3) refuses admission to for such inpatient treatment, may be admitted if a physician or nurse practitioner on the staff of the treating facility:
- Evaluates the individual’s medical condition and that the individual is incapacitated.
- Obtains informed consent from the agent identified in the individual’s directive.
- Determines, in writing, that the individual needs treatment or evaluation in an inpatient setting.
- Documents their findings and recommendations in the individual’s medical record.
A mental health professional must examine an individual within 24 hours of their admission if a physician or nurse practitioner other than a psychiatrist or psychiatric advanced registered nurse practitioner admitted the individual.
