“Unprofessional conduct under the professions and occupations law”
A psychologist must comply with the Office of Professional Regulation’s rules on professional conduct. Additionally, a psychologist may be disciplined if the board finds that they engaged in unprofessional conduct including:
- Failure to make available to a patient or a succeeding health care provider copies of the patient’s record upon written request;
- Engaging in any sexual conduct with a client or the client’s immediate family member with whom the psychologist has had a professional relationship within the previous 2 years;
- Harassing, intimating or abusing a client;
- Failure to comply with prevailing professional standards of care; or
- Failure to comply with professional ethical standards.
