“Hospital obligations under the health law”
Hospitals must develop internal policies and procedures to identify and analyze adverse events and near misses, determine what type of causal analysis is appropriate, conduct causal analyses and develop corrective action plans, and disclose to patients or, in the case of a patient death, an adult member of the immediate family adverse events that cause death or serious bodily injury.
Hospitals are required to:
- Report adverse events to the Department of Health and other agencies as required by law;
- Provide the department with copies of its causal analysis and corrective action plan regarding each reportable adverse event.
- For the purpose of evaluating a hospital's compliance with reporting requirements, provide the department access to patient information and records of peer review committees.
