“Genetic testing; limitations under the health law”
Genetic testing must be performed only with the individual’s informed consent and with a prior written authorization.
A person cannot be required to undergo genetic testing for an insurance transaction. However, an individual may be required to undergo a genetic test to establish parentage, to determine the presence of metabolic disorders in a newborn, for a criminal investigation or prosecution, for remains identification by the chief medical examiner; or for the state DNA data bank.
