Voluntary participation in the health information organization
Permits individuals to opt out of North Dakota’s health information organization (“HIO”) by notifying the HIO. Once an individual opts out, their individually identifiable information may only be accessed by the provider that created the information. Permits individuals to conditionally opt out so that their information is accessible to providers that need the information because of a medical emergency. Individuals may rescind their opt-out at any time. Prohibits providers or payers from denying care because of an individual’s decision to participate or opt to of the HIO. Clarifies that the opt-out does not impact the use or disclosure of HIO information as otherwise authorized by law.
