“Violation; classification; immunity”
Persons that knowingly disclose or compel the disclosure of communicable disease information without authorization or persons that knowingly perform or procure an HIV test in a manner that violates article 4 are liable for a class 3 misdemeanor.
Arizona grants immunity from civil or criminal liability to persons, health facilities, and providers that disclose communicable disease information, in good faith, as permitted by article 4. Health facilities and providers are also immune from liability that may arise if they fail to disclose communicable disease information so long as their decision not to disclose was made in good faith.
