“Abuse of facility patients under the hospitals and sanitaria law”
A residential care or health care facility and its employees must not physically or mentally abuse, mistreat, or neglect a patient. The attorney general is responsible for the investigation and prosecution of patient abuse or neglect in any health care facility. Any person who violates this statute is guilty of a misdemeanor for the first offense or guilty of a class B felony if serious injury results. For a subsequent offense, a person is guilty of a class B felony or a class A felony if serious bodily injury results. Any facility that evicts or retaliates against a patient, a patient’s personal representative, or an employee for filing a report is guilty of a misdemeanor.
