“Privacy and confidentiality protections under the public health law”
Any person allowed access to individually identified health information in the birth conditions program must sign a confidentiality agreement requiring adherence to privacy and security protections. The Department of Health and Human Services must maintain a list of any individuals given access to individually identifiable health information. Individually identifiable health information in the birth conditions program must be retained for 18 years. Thereafter, the program may retain the information only in a form where the individual’s identity cannot be discerned.
