“Review of restraint records by Department of Health and Human Services under the public health law”
The commissioner of health and human services must establish a process for periodic review of records of restraint usage of children kept by hospitals, community mental health centers, area agencies, and treatment facilities that treat or care for developmentally disabled children. The commissioner must also provide a process for complaints and investigations of reports of improper use of restraint in facility which may be through the Department of Health and Human Services or Office of the Ombudsman.
