“Review committees; immunity; confidentiality; definition”

Arizona provides immunity for civil liability that may arise in connection with a person’s participation on an Arizona health care cost containment system (AHCCCS) review committee or a person’s provision of information to an AHCCCS review committee. Such immunity only arises in the person acts in good faith and without malice.

Arizona classifies AHCCCS review committee records, proceedings, and information as confidential. Such information may not be subpoenaed unless the subpoena is related to a state licensing or certification proceeding or the information sought is a patient medical record that is generally discoverable.
