Research studies confidential
Classifies information used or procured for research purposes by the Department of Health or persons, organizes, or agencies working with the Department as confidential. Prohibits the use of such information for non-research purposes. Prohibits the use of research information as evidence in a court of law or other hearing and prohibits the disclosure of research information unless disclosure is necessary for the research project. Requires Department employees to obtain the consent of a patient’s physician or surgeon prior to interviewing the patient or their relative. Clarifies that the act of providing information to the Department for research purposes does not expose the people or organizations that provide the information to liability.
