Requirements for Requests for Medical Records by Hospital Inpatients – Ind. Code Ann.§ 16-39-1-6

An individual who is currently an inpatient in a hospital or health facility is not authorized to obtain a copy of his or her health records while still in the hospital or facility. However, the medical records may be released under the following circumstances:
- If the inpatient is unemancipated and less than 18 years old, a parent, guardian or next of kin is entitled to obtain a copy of the health records of the inpatient.
- If the inpatient is incompetent, a spouse, parent, guardian or next of kin is entitled to obtain a copy of the health records of the inpatient.
- If the inpatient is competent, a spouse, parent, or next of kin is entitled to obtain a copy of the health records of the inpatient if the inpatient requests that the records be released.
