Reporting by employees - 35 Pa. Stat. Ann. § 10210.501

Employees and administrator of the following facilities are subject to reporting requirements:

  • An assisted living residence;
  • A domiciliary care home;
  • A home health care agency;
  • An intermediate care facility for people with mental retardation;
  • A long-term care nursing facility;
  • An older adult daily living center;
  • A personal care home;
  • A residential treatment facility; and
  • An organization or group of people that uses public funds to provide care or support to adults in a licensed or unlicensed setting.

Such employees and administrators must immediately report a reasonable suspicion that a recipient has been abused or neglected to a local contracted provider of protective services agency; within 48 hours of reporting, the employee or administrator must submit a written report to the agency.  An employee or administrator must immediately report a reasonable suspicion that a recipient is the victim of sexual abuse, serious injury or serious bodily injury or that a death is suspicious to the agency, the department of public welfare and appropriate law enforcement officials; an employee must immediately notify his administrator after reporting to law enforcement, unless such notification would jeopardize the investigation or subject the recipient to further risk.  Within 48 hours of reporting, the employee and the administrator must submit a joint written report to law enforcement officials. 

Written reports must include the following information:

  • Name, age and address of the recipient;
  • Name and address of the recipient’s guardian, attorney-in-fact or next of kin;
  • Name and address of the facility;
  • Nature of the alleged offense; and
  • Any specific comments or observations that are directly related to the alleged incident and those involved.
