Policies
Requires mental health and substance abuse programs to create policies that outline clients’ rights. Grants clients the right to the confidentiality of their clinical records and communications with staff. Classifies the fact that a person is receiving mental health or substance abuse treatment as confidential unless disclosure is authorized by 42 C.F.R. Part 2. Prohibits disclosure of confidential client information, without authorization, unless the disclosure is necessary to protect against imminent harm, report the abuse of a child or adult, perform peer review activities, or is authorized by federal law.
