“Order for disclosure of communicable disease related information”
Arizona prohibits the use of a court or administrative order or warrant to obtain information related to a communicable disease unless the order or warrant is issued in specified circumstances. These circumstances include when there is “a clear and imminent danger” to a person that may have been in contact with the person about whom information is sought or a “compelling need” that necessitates disclosure of communicable disease information. Arizona requires courts and administrative bodies to seal files related to requests for an order authorizing or a search warrant for communicable disease information. Such orders or warrants must be written to limit disclosure and access to the information and prohibit redisclosure.
Courts or administrative bodies may not compel the department of health services, county health departments, or a local health department to release HIV information unless otherwise authorized by law.
