Nursing home facility staff, employees or agents are prohibited from abusing residents. The following individuals are required to report abuse or suspected abuse to the Department of Human Services or to law enforcement:
- Physicians, including a resident or intern;
- Licensed nurses;
- Employees of the Department of Human Services or the county health or mental health department;
- Contractors;
- Peace officers;
- Clergy;
- Licensed social worker;
- Physical, speech or occupational therapist;
- Family member or guardian of a resident.
The nursing facility administration must immediately notify the Department of Human Services of instances of abuse or suspected abuse. An abuse complaint must include the names, addresses, and phone numbers of the resident, alleged abuser and any witnesses, the nature of the abuse, any explanation given for the abuse, and any other helpful information.
