This regulation applies to all providers of chemical dependency services certified, licensed, operated or funded by the New York Office of Alcoholism and Substance Abuse Services. The Department of Mental Hygiene recognizes the importance of conducting research to gain knowledge on issues related to chemical abuse and dependence, but sets down some limitations to ensure that patients’ rights are upheld.
This regulation prohibits participation in research that conflicts with their treatment plan. The regulation requires that all research projects involving human subjects receive approval in accordance with federal law--45 Code of Federal Regulations part 46.  It further requires that informed written consent be obtained from any patient who participates in such a research project as a human subject in accordance with federal law--45 Code of Federal Regulations part 46.
