Nonpublic dislcosure in emergency circumstances
Authorizes public health officials to disclose protected health information to health care providers, law enforcement, or emergency medical personnel when an imminent threat of physical or mental harm to that person exists. Permits disclosure of an individual’s PHI when that individual poses a threat to identifiable persons or groups, has the ability to carry out the threat, and disclosure is necessary to eliminate or significantly reduce the threat. Limits disclosure to the minimum mount necessary and clarifies that persons receiving PHI may only use it for the purposes stated in this chapter.
