Disclosure
Health carriers must disclose the following information in their marketing materials to individuals and small employers:
- The methodology for calculating premium rates;
- Provisions regarding carrier’s right to change premium rates;
- Provisions regarding renewability of health care coverage;
- Benefits and premiums available under all health insurance coverage for which the employer qualifies.
All health carriers and third party administrators must electronically provide:
- Encrypted claims data to the Department of Insurance and Department of Health and Human Services;
- Cross-matched claims data on certain policyholders and subscriber information to the Department of Health.
However, the law notes that the collection, storage and release of protected health information will be governed under HIPAA.
All health care plans that collect HEDIS measures must report these measures to the Department of Insurance. All health carriers must submit electronically submitted claims using the CMS forms.
