“Duties and responsibilities under the division of public health services regulations”
A nursing home is responsible for meeting a variety of requirements including:
- Complying with the patients’ bill of rights set forth in Revised Statutes of the State of New Hampshire §§ 151:19 to 151:21;
- Monitoring the quality of care and service provided to residents on an ongoing basis;
- Consider all residents to be competent and capable of making health care decisions unless the resident has a court-appointed guardian, has a durable power of attorney for health care, or is an un-emancipated minor;
- Posting in a public area: a current license certificate; all inspection reports; a copy of the patients’ bill of rights; a copy of the nursing home’s policies and procedures regarding patient rights and responsibilities; a copy of the nursing home’s complaint procedure; and the nursing home’s floor plan for fire safety, evacuation and emergencies identifying the location of all fire exits;
- Providing copies of clinical records to residents or a resident’s guardian or agent upon request;
- Developing written policies and procedures regarding electronic records to protect residents’ privacy;
- Reporting unusual incidents to the Department of Health and Human Services;
- Providing a list to a resident of all known applicable charges and identify what care and services are included in the charge at the time of admission; and
- Providing a resident written notice within 30 days for an increase in the cost or fees for any nursing home services.
