N.H. Rev. Stat. Ann. § 151:30 - Equitable and Other Relief
This will open in a new window
These requirements apply to a licensed health facility, building, or residence, but do not apply to health care provider's offices or community health clinics.
If a health facility violates any of the requirements governing such facilities, including a patient's right to access health information in his or her medical record, the person harmed by such violation may seek equitable relief from the superior court. The facility will be liable for $50 for each violation per day, or for all damages proximately caused by the violations, whichever is greater. If a facility is found to be in contempt of a court order issued in such action, the facility will also be liable for the plaintiff's reasonable attorney’s fees and costs.
