“Complaints under the division of mental health and developmental services regulations”
A complaint may be made by any person including an individual, the individual’s guardian or family member, an applicant for services, or an employee of the Department of Health and Human Services, an area agency, or a program. The complaint must be made orally or in writing to the Office of Client and Legal Services. A complaint may be made anonymously. No individual may be subject to any form of harassment or retaliation by any area agency, program, or department employees as a result of filing a complaint. An individual’s services may not be discontinued or amended as a result of the individual’s complaint except when medically necessary. A department, area agency or program employee may not be disciplined, harassed or retaliated against as a result of filing a complaint.
