Michigan requires the department of community health and the department of human services to disclose information regarding nursing home ownership, licensure, evaluation, inspection, costs and reimbursements, and complaints and investigations. The department of public health, the department of social services, and nursing homes may only disclose patient identifying information pursuant to a court order or to a patient’s relative or guardian following the patient’s death. The public may not inspect “confidential medical, social, personal, or financial information” if such information identifies a patient.
The limitations placed on the department of community health, the department of human services, and nursing homes do not affect the ability of a patient or their representative to access the patient’s clinical record.
