Waiver of privilege; permissible communication; disclosure not as violation of law
The physician-patient privilege requires a physician to keep confidential any information obtained while treating a patient if the information was necessary for treatment. However, an individual will waive this privilege if they give a health professional or health facility notice of a pending malpractice claim. The waiver is limited to information related to the claim. Any physician notified of a medical malpractice claim may contact individuals to obtain information in preparation for their defense to the claim. Those individuals providing the physician with relevant information for his or her defense does not violate any disclosure or confidentiality laws.
