Confidentiality; violation as misdemeanor; penalty
The Commissioner is responsible for maintaining the confidentiality of records that contain an individual’s identifying information. The Commissioner may only disclose such information if the individual authorizes disclosure in writing, a court mandates disclosure, or the law requires disclosure. If the Commissioner discloses information outside of the abovementioned circumstances, they disclosure must not identify any specific individual, unless the individual authorized, in writing, the release of the personal data.
Violations of these confidentiality requirements are misdemeanors subject to a maximum fine of $1,000 per violation.
