Fraudulently obtaining or attempting to obtain a controlled substance or a prescription for a controlled substance is illegal. An individual guilty of this offense may receive a sentence of up to 4 years in prison, a fine of up to $5,000, probation, or substance abuse treatment.
The physician-patient, dentist-patient, or other health professional-patient privileges do not protect medical records or information related to an individual’s fraudulent conduct or attempted fraudulent conduct. A person that releases medical records or information under this section in good faith is immune from liability unless their actions were grossly negligent or constitute willful and wanton misconduct.
