If a person dies while infected with an “infectious agent,” the physician that completes the death certificate must disclose the presence of the infectious agent to the funeral director, or their agent, that will obtain custody of the person’s body. A funeral director cannot refuse to provide services because of such notification and must keep the information confidential.
“Infectious Agent” includes HIV and other agents as defined by the department of community health.
